League Adopts New Position: Federal Judiciary 6/28/25

In June 2025, the League of Women Voters national Board was pleased to announce the adoption of the new League position on the Federal Judiciary.

The Federal Judiciary position was adopted using the long-standing League practice of grassroots study to arrive at member understanding and agreement. 321 Leagues representing 45 states and the District of Columbia participated in the study.

The League of Women Voters of the United States (LWVUS) believes that all powers of the US government should be exercised within the constitutional framework of thecbalance of powers among the three branches of government. The League believes that,cwithin the bounds of the US Constitution, the overarching principles of transparency,caccountability, independence, and ethics are essential to an effective federal judiciary.

These principles are not only essential for a strong democracy but foster public trust in the federal judiciary and adherence to the rule of law, the essence of our constitutional democracy.

Supreme Court Decisions

On the last day of their term, the Supreme Court announced that Louisiana v. Callais will not be decided but will be re-argued during the October 2025 term.The case centers on congressional districts drawn by the state of Louisiana and considers whether those districts violate the 14^thAmendment.
SCOTUS used its shadow docket to issue a decision with no opinion or hearing, allowing the Trump administration to deport migrants to countries other than their country of origin without due process.

Standing for the Rights of Protesters, Politicians, and Public Officials

The League stood in firm support of the right to protest and condemned violence against activists in Boulder, CO, and federal use of force in Los Angeles County, CA.
The League also expressed concern at the indictment of Representative Monica McIver and the violent removal of Senator Alex Padilla from a press conference. Both incidents, as well as the Los Angeles protests, are connected to the Trump administration’s attacks on the migrant community.
LWV spoke out about President Trump’s direction to the Department of Justice to investigate his political rival, former President Biden.
LWVUS and LWV of Minnesota condemned the tragic political assassination of Speaker Emerita Melissa Hortman and her family, as well as the shooting of Senator John Hoffman and his family, stating, “political violence has no place in our democracy.”

Defending Democracy in the Courts

The League of Women Voters of Florida and partners acted to block key provisions of a bill that puts sweeping restrictions on the state’s ballot initiative process.
LWV and partners also filed legal briefs urging federal courts to invalidate an illegal executive order that seeks to revoke birthright citizenship.
The League of Women Voters of North Carolina and partners seek to intervene in a lawsuit that wrongly challenges the eligibility of more than 200,000 voters.
